There is no state law in any state that regulates the use of a swimming pool owned by an association -- that I can find.

Your governing documents may set the hours, and it's the responsibility of the association to assess and balance its pool hours with the liability those hours present to the association.

If you believe that the open pool has become an 'attractive nuisance' to non-residents, or otherwise poses a danger of someone drowning, you can report your evidence to the board and request that a review of pool hours be made, so as to limit the association's exposure to a lawsuit.
