The answer can vary. If you are sent a 1099 at the end of the year you may be considered a subcontractor. Assuming you do not have employees of your own and that you are not directly supervised, use your own equipment (computers, etc.), and provide services for others you may be considered an indpendent contractor and not included in coverage. If this is the case your payroll will not be included by your employer's workers compensation carrier for premium calculation. But this also means if you are injured performing your work you will not be able to file a claim (or you will be able to but it will not be covered.) If, instead, you are on the actually payroll of your employer (W2 employee) then you very well could be covered by workers compensation coverage. At the end of each policy period an audit will be performed on your employer's policy. The auditor will ensure that the insurance company has the correct payroll for premium calculations and that all of the payroll is classified to the correct class code (which determines the rate for premium calculations) If they pick up your payroll for premium calculation then you are technically included in coverage. This would, in turn, give you the right to file a claim if you are injured during the normal course and scope of your duties. There is a special NCCI classification used in most states that covers telecommuting employees (8871) This may be why your company views you as a risk because they may be charged premium based on your payroll. If you are classified correctly though (either 8810 which is a clerical code or 8871) the codes your payroll will be classified to are very low rated (in most states the clerical code is less than $0.40 per one hundred dollars of payroll)
