Defendant. He has to defend him self against the plaintiff's accusation.
That will depend on whether the case is a civil or criminal trial. In a civil court case the two sides are the defendant and the plaintiff. For a criminal court it will be the defendant (the accused) and the government entity bringing the charges, usually the State or Country.
The person on trial in a court of law is typically referred to as the defendant. They're the one being accused of a crime and trying to prove their innocence... or guilt, if they're not too bright. Just remember, it's innocent until proven guilty, but some folks make it pretty darn obvious.

The defendant is the person that is being accused of something.
There are a few names. Suspect, Person of Interest, and Defendant to name a few Murderer,Robber,Rapist,Killer
In the United States federal court system, the document used to initiate a civil lawsuit against a defendant is called a complaint. In the state court systems, this document is usually called a petition.

The PLAINTIFF, is the aggrieved party who is initiating the lawsuit (i.e.- the one who is suing). The DEFENDANT is the party against whom the suit is being brought (i.e.- the one being sued). Depending upon the court system, sometimes the DEFENDANT is known as the RESPONDENT.
None unless the error directly affected the decision of the matter. For example, if a defendant's name was misspelled but the defendant did prove to be the person in question it would have bearing on the case.
The person who takes a criminal case to court is typically known as the prosecutor. The prosecutor represents the government and is responsible for presenting the case against the defendant. In some contexts, the term "district attorney" or "state attorney" may also be used, depending on the jurisdiction.
You can refuse to accept them telling the server that you are not the defendant. If you already have the papers, send them back to the plainitff or attorney and state that you are not the defendant. You must not ignore this. If you do, plaintiff will get a default judgment against you and you will have to go to court to have it set aside. That will cost you money and a damaged credit history.
