There are guidelines and understandings about what is acceptable and what is not acceptable behavior during war. Over and above that, there are actions that are considered criminal, and the fact that these acts are done during war time does not permit or excuse them. For example, the Jewish Holocaust was criminal to an unimaginable degree, and it was more than legitimate to hold people accountable for that, independent of war activities. If anything the world should be embarrassed that we were not more aggressive seeking out and prosecuting those responsible. Mass genocides are never acceptable whether there is a declared war or not.
