No they shouldn't, as much as we like to think people are in control of their own actions people with mental health issues are not all of the time that is why they need medication. For example a person experiencing mania who has bipolar does not realise it because they are completely delusional and feel extremely good with loads of self confidence so they don't see a problem and their thought process is so out of control and fast they cannot think straight so it would be unfair to give them the same punishment as some one who is in control of their behaviour, they should still get punishment but not as severe because as much as we like to think their in control most of the time they are not. But if they realised what they did was wrong and had control then they should, but it should be up to the courts to decide if their actions were because of their mental illness. So all in all we should take into account that mental illnesses can disrupt peoples lives and can cause people to behave in completely strange ways and not all of the time a person can help it.
Of course! Why shouldn't they?! The insane and mentally retarded are human beings, just like everyone else. Their condition(s) are caused by events that are out of their control, so it is not fair to punish them for such things.

There is no revenge like repentance. There is no punishment for one's desire to know something beyond one's capacity. There are some people who have personal curiosity to know something beyond their knowledge. Those people are mostly poet, philosophers, writers, etc. or in other words they are known as social observer. Mostly such people never enjoys their life at the moment but their knowledge somehow contributes in the society in long run to come. So the punishment itself is frusturation or wisdom.
Those that are mentally impared in some way. Called the McNaughten rule after a famous case in Great Britian, it excused the mentally ill from criminal prosecution and instead the defendant was hospitalized and treated.
The only reason harsher punishment is suggested when a wrong is committed is to satisfy the want for cruelty in those that do the punishing. and in the case of the law to seem to be doing something without actually having to go to any trouble. The punishment for cruelty to animals and all our fellow creatures for that matter, should be the responsibility of nursing the injured back to health. This will help most of them understand that what they do is wrong in their own mind.
