Criminals are criminals regardless of their backgrounds and they should be treated identically. The fact that the individual may be orphaned might be useful to their defense attorney as a possible presentation for sympathy in their defense. However, if you end up dead as the result of an armed robbery would you really care if you were killed by an orphan or somebody who came from a solid home? You're just as dead! And they are just as much of a criminal regardless of their personal circumstances.

There are most likely laws or statures already in place regulating this situation based on the details of the incident. Depending on the age, most will be treated how other children of their age group are. However, orphaned, abused, etc, children are usually more prone to negative activities because of their troubled past.
