If she is under the age of 18 she is a minor and under the care of possibly custody shared by your brother and his ex wife. On the days your brother may get your niece to spend time with her then you have a chance to spend time with her. Talk to your brother about how you feel. If your niece is 18 or older then she is no longer a minor and it is up to her whether she wants to spend time with you.
