Section 9 of the Constitution Act, 1867 vests executive government and authority in the Queen. The Queen appoints a representative, the Governor General of Canada, on the advice of the prime minister. Once bills have passed both Houses, they are presented to the Governor General (representing the Queen). The Governor General grants royal assent to bills for the Queen (the Queen's role in Canadian legislation is referred to as the Queen-in-Parliament, and forms the legislative branch of government).

The Queen is also the Fount of Justice for Canada. Justices of the Supreme Court, and judges on the Federal Court and the superior provincial courts are made by the Queen (represented by the Governor General) on the advice of the prime minister. Decisions, sentences and remedies are handed down in the name of the Queen (the Queen's judicial role is referred to as the Queen on the Bench, and forms the judicial branch of government).
