All medical records are treated the same under HIPAA, without regard to the form the record is kept in: Paper, Electronic, Mixed Media, X-Rays, etc. HIPAA applies to electronic medical records as much as it does to paper records. The patient still needs to sign a release for information to be transferred to other providers.

Unless a longer retention period is otherwise required under federal or state laws or regulations or by generally accepted standards of medical practice, a licensee shall keep and retain each record for a minimum of 7 years from the date of service to which the record pertains.
Not directly. A physician under their employ can be sued for malpractice if he treated you. If the issue is an insurance or coverage decision that was made based on chart review then you can't sure for malpractice.
