In accordance with Roman law, all who were killed by way of crucifixion, to verify true death, the soldiers were to break the legs of the criminals (this also prevented them from attempting to run away if they weren't dead, after they were taken down from the cross). But, because the soldier saw Jesus was dead, he was instructed to pierce him in the side.

A person nailed this way would tear away from the nails before they died. So they nailed through the wrists and ankles. Many think that the Roman soldier who speared Jesus in the side was trying to torture Him, but that was simply how they determined if the person had died, yet.
