Well, there are two aspects to this question.
The first aspect is the legal side of things. If you are caught, you will probably be going to court for what you did. The punishment would probably be a fine of some sort, or maybe probation/community service. I don't know what the punishment is if you already have a spotty record, but I imagine it would be much worse.
The other aspect is the DMV side. The DMV has its own rules about these types of things. If you are caught driving with only a permit in New Jersey (or probably any state, for that matter) the DMV will likely delay the time you must wait for your license for at least 2 years.
Please don't drive alone with just a permit, it poses a threat to you and others and you will regret the consequences. I am not saying that you are a bad driver, but it is in your best interest to wait until you get your license.

That depends on the jurisdiction in which the unlicensed driver is caught. In general, the driver is arrested and charged with "Driving Without a License" or whatever the offense would be called. It can probably get more complicated if the unlicensed driver is caught outside his/her state of residence.
