The Sixteenth Amendment (Amendment XVI) to the United States Constitution allows the Congress to levy an income tax without apportioning it among the states or basing it on Census results. This amendment exempted income taxes from the constitutional requirements regarding direct taxes, after income taxes on rents, dividends, and interest were ruled to be direct taxes in Pollock v. Farmers' Loan & Trust Co. (1895). It was ratified on February 3, 1913.

The 16th Amendment to the U. S. Constitution cleared the way for Income Taxes.
The 16th Amendment made it legal for the Congress to lay and collect taxes on income. It is the contention of some that because the Congress does NOT do the collecting directly, that is done by the IRS a division of the Executive Branch, every dime of income tax ever collected by the IRS has been collected unconstitutionally. In the US Government, the Executive Branch is responsible for enforcing the laws passed by the Congress.
The 16th Amendment gave Congress the right to collect income taxes. The 17th Amendment established that the Senate would be comprised of two senators from each state. The 18th Amendment established the prohibition of alcohol.
