Every crime is different. treating all offenders of a certain type of crime- for example possesion of a certain quantity of drugs, minimizes attempts towards re-habilitation ( in both sense of the word) and hampers the discretion of the Judge, who is indeed a learned man or woman of the Law. what might work towards justice with one defendant, might not with another. Simply slamming people in Jail for a fixed sentence- could be construed as unusual , and perhaps cruel punishment. each case is supposed to be handled individually as far as the structural limits of the judicial system go.

We make laws saying that it is illegal to murder, but we are murdering by using the death penalty. If murder is going to be illegal, no one should be able to murder, including the government.
