Every crime is different. treating all offenders of a certain type of crime- for example possesion of a certain quantity of drugs, minimizes attempts towards re-habilitation ( in both sense of the word) and hampers the discretion of the Judge, who is indeed a learned man or woman of the Law. what might work towards justice with one defendant, might not with another. Simply slamming people in Jail for a fixed sentence- could be construed as unusual , and perhaps cruel punishment. each case is supposed to be handled individually as far as the structural limits of the judicial system go.
