The Criminal Justice System under the Philippine has five (5) major components namely:

Law enforcement
Prosecution
Court
Correction
Community


Before anyone could delve into the Criminal Justice System it is but proper to conceptualize first on its core which is common to us as "CRIME" for without which our quest for justice has no substance.

Crime is the substance where the system evolves. This is indeed true that the maxims of Criminal Law which state "Nullum Crimen Nulla Poena Sine Lege" exist.

Criminal Justice System therefore is the process of linking the five major components whereby the Police when crimes are committed conducts an impartial investigation, gather evidence necessary to prove the guilt of a person believed to have committed an offense.

The prosecutor on the other hand, evaluate the complaints and other documents submitted inclusive of evidence to see to it that probable cause exist and the person charged under the complaint is probably guilty thereof. Prosecutors however. conducts Preliminary Investigation except in few instances that the same is no longer required in order to engender sufficient ground that a crime had in fact been committed. He caused for the filing of information in court after a resolution has been accomplished by him.

The court try cases and if the subject of the complaints and information is found guilty beyond reasonable doubts it results to the latter's conviction where at this instance the person will be subjected to the care of the corrections administration for the necessary treatment and or rehabilitation under a community based corrections or institutional correction whichever deemed appropriate depending on the penalty imposed.

After or even at the middle of the service of his sentence the convict maybe released from imprisonment absolutely or conditionally for his reintegration into the community.

2. To protect the public from criminals.

3. To seek appropriate sentences for criminals.

4. To investigate crimes when necessary (an overlap of police functions).

5. To eventually run for public office.

JUDGES

1. To give rulings that are legally correct.

2. To uphold justice.

3. To protect the public.

4. To maintain respect for the legal system.

5. To be neither too harsh nor too forgiving.

JURIES

1. To exercise good judgment in reaching a verdict.

2. To comply with instructions of a judge.

3. To uphold justice.

4. To understand the issues and facts of a trial to the best of their ability.

5. To refrain from any personal bias.
