By the Constitution, Congress is granted the sole power of declaring war. The War Powers Resolution of 1973 gave a small war power to the President; he can send a limited amount of troop into battle and he has 48 to get Congress' approval.

The congressional war powers are both extensive and substantial. They are as listed:

  1. Only Congress can declare war.
  2. It alone has the power to raise and support armies, to provide and maintain a navy, and to make rules for the governing of the nation's military forces.
  3. They have the powers to provide for "calling forth a Militia" (Today the National Guard), and for the organizing, arming, and disciplining of that force.
  4. Congress is also given the power to grant letters of marque and reprisal, and to make rules concerning captures on land and water.
