I assume you are saying that someone claimed her as a dependent on their tax return?

Don't worry about what anyone else did. If you (or somebody else) are entitled to claim her on your return, then just file your own return claiming her. If this other person already claimed her, you won't be able to efile, you will have to file a paper tax return. The IRS will of course notice that two of you claimed her and will follow up and try to resolve the situation between you. If nobody is entitled to claim her, then she should of course file her own return and not check the box that asks if someone else could claim her and she should claim her own exemption. Again, she may have to file on paper.

If this is not causing you an actual problem with filing your (or your mother's) return and you just want to report this person for the sake of reporting, then see the following:
