If the 16 year old incites the 12 year old to anything illegal, file a complaint for "contributing to the delinquency". But even more important. Talk to the 12 year old. Try to figure out what he/she is getting from the relationship. It is probably something that your family should be providing and either the child isn't getting the nurturing or he/she doesn't understand what is going on. Remember the old football adage (I hate football, but this one makes sense.) "The best offense is a good defense.". A good relationship with your child and working out the issues of adolescence together will be a thousand times more valuable than any legal victory.
