Can your paycheck get garnished for an unpaid credit card?

Even if a credit card company sues you and wins, the judge can only say that you do owe the money. He can attach a lien to your credit file which would prevent any new creditors from granting credit until the debt is taken care of. If you are in bankruptcy the rules change, each state has different laws. If the credit card company sues and receives a judgment in their favor your wages can be garnished up to an amount set by your state's laws.

How does a credit card collector earn a judgment in their favor?

They go before a judge and explain how the payment for that credit card was not made and what is owed including collection costs. The cost of judgment is then added to the total and that becomes the collectors judgment. That stays on your credit report for a long time so avoid!

What is the difference between an agreed judgment and default judgment and will both have equal impact on credit ratings?

There's no difference in how the judgment is entered on a credit report. An agreed judgment indicates the debtor(s) appeared in court but did not have a valid defense as to why the debt was not owed, therefore a judgment was entered against him or her. A default judgment indicates the debtor(s) did not appear in court thereby forfeiting the right to defend the suit, resulting in a default judgment being entered in favor of the plaintiff. The execution procedure of either type judgment is also the same.

Can I get a mortgage with a judgment against you from an unpaid credit card I have fairly good credit otherwise but I have a judgment against me for an unpaid credit card from 2003. Thank you?

one of 3 things could happen.1. denial of loan2. the mortgage company will pay the judgment and tac it on.3. or require you to pay it and provide proof that it is satisfied.*** here is what you need to do**tell the person who has the judgment you are considering filing a chapter 7 bankruptcy, and that you will include them in it unless they agree to settle for 50% of the amount and agree to delete the judgment and the account from your crfedit file all 3 of them. make sure you get their signature in writing first and that you agree to pay them within 30 days .or you could dispute it with all 3 credit bureaus and hope they don't respond and it falls off but be aware all 3 credit bureaus and most creditors are computerized and will reponse very quickly. it will work out in your favor. The judgment will remain in the Public Records section of the credit report for seven years. In some instances a judgment can be renewed,if so, it can remain on the credit report indefinitely. Can a company legally assess a chargeback fee against a consumer?

If you're talking about a credit card charge you disputed with the credit card company and the credit card company determined the dispute in your favor generally no. The other question you have to ask yourself however is if you received a good or service in exchange for what you charged to your card? Just because the credit card company determined the dispute in your favor and charged back the company, they don't lose the right to sue you or send you to a collection agency for a good or service you received. If the company sues you in court, they may be awarded the chargeback fee in addition to the amount owed in order to cover all damages that you caused them.
