No it is not illegal, as long as you have operational tail lights, brake lights, signal lights and a plate light.
access to the rear brake lights is inside the vehicle. Open the rear hatch and on the rear corners of the vehicle, you will see a small cover plate. Take the cover plate off and this will give you access to the lights.

Try replacing the headlight switch. Do the front parklights work and not the rear ones? If so check the harness to the rear of the vehicle for breakage.
