Because he is a living person and only the dead must stay in the Underworld. Also, he does not go into the Underworld, but speaks to it's ghosts.

Elpenor: Odyssyeus listens to Elpenor's story and promises him a proper burial. Anticlea: Odysseus is somewhat shocked because he was unaware of her death in his absence.
