The two treaties of Velasco were negotiated between officials of the ad interim government of the Republic of Texas and Santa Anna, the Mexican dictator and commander of forces, about three weeks after his capture by the Texans at the Battle of San Jacinto. The "public" treaty, presented below, was to be published and implemented immediately after it was signed. A second "secret" treaty was to be implemented after the terms of the public treaty were fulfilled. In essence, the secret treaty provided for Santa Anna's immediate release in exchange for his recognition of Texas as an independent nation. However, the treaties were soon violated by both parties. The Texas army blocked Santa Anna's release, as promised in the treaties. Meanwhile, the Mexican government declared void all of Santa Anna's acts while in captivity. Together, the treaties somewhat loosely established Texas' southern border at the Rio Grande River, but this issue would not be finally resolved until 1848--after Texas statehood and the conclusion of the Mexican War.

What would happen to General Santa Anna according to the public Treaty of Velasco?

According to the public Treaty of Velasco, General Santa Anna was to be treated as a prisoner of war and was required to withdraw his troops from Texas. The treaty also stipulated that he would recognize Texas' independence and work towards its formal recognition by the Mexican government. However, the treaty's legitimacy was disputed, and Santa Anna later claimed he was coerced into signing it. As a result, the treaty's terms were not fully honored, leading to contentious relations between Texas and Mexico.

Which territory did America have best claim to Texas or California?

To Texas since it had held Independence under the Treaty of Velasco for almost a decade as a proclaimed Inde[endent Republic prior to applying for statehood. California could ponly be claimed as a part of its occupation during time of war. The failure of Mexico to ratify the Treaty of Velasco was not a US problem, nor was the failure of Texas to comply fully with the terms of that Treaty. The US could at least claim to have been dealing in good faith with the Republic of Texas.
