How do you stop a stalker if he is related to you?
Well, it doesn't really matter if the person is related to you. Stalking violates anti-stalking laws regardless if the perpetrator is a relative. So, first, if you haven't already, call the police and file a report that this person is stalking you. I don't know what jurisdiction you're in, but most states have anti-stalking laws nowadays. Next, contact the domestic violence section of the court in your jurisdiction and ask about filing a petition for a restraining order, civil protection order or whatever the document is called in your jurisdiction. The court will probably ask you to come in and fill out some papers explaining the stalking and what the stalker has done. Take any evidence of the stalking that you have with you to the court house. Examples of evidence are notes from the stalker, tapes of phone messages the stalker has left you, police reports, a journal you've kept of the stalking, photos of any injuries he's inflicted on you if applicable, etc. After filling out the forms in the domestic violence section of the court, you will see a judge. If your case appears to have merit, the judge may issue a Temporary Restraining Order that lasts 2 weeks or so until a hearing can take place. At the hearing you would prove your case, e.g. present any evidence you have of the stalking (if you have witnesses of the stalking they must appear in court in person - their statements would not be admissible) and cross examine the stalker. If the judge finds that you've shown that this person is stalking you in violation of the applicable laws, the judge will issue a restraining order that likely lasts 1 year. In that instance, if the stalker violates the order you can call the police, have him arrested and press charges. If the stalker is properly served (the employees at the courthouse will explain the service requirements in your jurisdiction) and does not show up for the hearing, the judge will likely issue a default judgement, which means that you would still get the restraining order.
