A 12yo can not do this. As long as she is a minor it's the parents who decide who she will live with. If the parents can not agree they will bring it to court and if the judge allow it, the minor can at a certain age (differs between states) speak her mind on who she wish to live with but the judge is in no way obligated to go along with that wish.
