Hmmm. BASED on, or COPIED from? That is the question. Several other questions arise; Is the original work you are "basing" your work on copyrighted? Does the person whose work you are referring to know of your commission? Does your customer know that he is not commissioning an 'original' work, and that you are "basing" it on someone else's?
