Particle theory is a theory because it is someone's idea. Theory means "An assumption based on limited information or knowledge". So, the partcile theory is a theory because it is someone's idea on how all matter is made of of tiny particles.
It is impossible to completely prove, (theory,) and deals with particles.

To test for...

A gas: The particles are further apart, less dense, so experiments can show this. Gases can be compressed etc.

A liquid: The particles are further apart than solid, so they flow. Liquid in a glass shows this.

A solid: Particles cannot flow as are too packed together. Solid in a glass shows this.
