Until 1850, the free state versus slave state issues were solved by the US Compromises, the last one being the Missouri Compromise of 1850. However, as the US expanded westward, new states were going to have the same problems if Congress continued to try and hammer out compromises to allow the balance of slave and free states to be equal. It came to the point where a more democratic and citizen participation solution seemed proper. As the Kansas and Nebraska territories were on their way to applying for statehood, the nationally known and respected Illinois Senator Stephen A. Douglas found a way to keep Congress out of the slave and free state discussions. Douglas put forth to Congress what seemed to be the most logical idea. The idea did not involve the national debate among politicians in Washington DC calling the "shots" in a manner of speaking.. His Kansas-Nebraska Act of 1854 put the age old slave and free state debates in the hands of the voters.His idea, termed "popular sovereignty" would allow the settlers in new territories vote on the slave issue before the territory applied for statehood.

The idea was perfect, its execution not so much. Left to the voters, well pro and anti-slavery people had armed conflicts in Kansas over the issue. Much bloodshed displayed that such decisions could not yet be placed in the hands of powerful interests that tried to control the voting. In Kansas, there was armed and bloody conflicts over the slavery issue. This the term "bloody Kansas".
