At sentencing, the verdict (decision of the judge or jury) is announced and you can either immediately be taken away to begin your sentence (or pay your fine), or given a certain amount of time to get your affairs in order before you report to jail/prison.

It is possible that immediately upon having the verdict delivered, the judge may pronounce sentence. Oftentimes, however, the sentencing phase of the trial will be a separate proceedings which will take place within a short time after the verdict was delivered and the trial ended. During this intervening time the judge may request a pre-sentence report and/or research precedent, applicable law, and possible penalties prior to convening the sentencing hearing.

Sentencing can occur at any time from the moment the person is found guilty, up to a couple months later. Normally the judge will order a presentence investigation if the person was found guilty at trial. Oftentimes sentencing occurs as the result of a plea offer that the defendant has taken and the court has accepted.

At the sentencing hearing the state or federal government will argue its case for which it feels the defendant should be sentenced to. The defense follows, obviously for a shorter sentence. The judge could then ask anyone, for example, the victim or his family member, to speak to the court or to the defendant, in the form of what is known as a victim impact statement. Then, the judge will ask the defendant if he has anything to say prior to his sentencing.

The defendant will then be asked to stand up for his sentencing. The judge will then come up with a speech to explain why he came up with the sentence he is about to impose. Finally the judge will impose the sentence. The defendant is then escorted from the courtroom in handcuffs to begin his sentence, or will be asked to report to the courtroom at a later date to begin such sentence. If the sentence is probation, the defendant will be ordered to report to the probation office immediately after the hearing.
