He is not guilty of statutory rape since the age of consent is 16. The legal age to move out is 18 unless you are pregnant and then you can marry without parental consent. The 16 year old can also seek emancipation without marrying. If you don't get emancipated or married you have to follow your parents rules since you are still a minor. You decide over your baby and they decide over theirs.
