The previous answer is partially correct. Insurance does not change legal liability. If that person happened to be running an errand for you, that person could be legally considered your agent, thereby making you co-legally liable. Otherwise, as a general rule, you are not legally responsible for the actions of others. Also, check the state financial responsibility laws of the state you live in. Some states (California) require the owner of a vehicle to maintain a minimum amount of insurance, and the owner could be responsible up to the limit of liability imposed by the state.

If your state requires insurance, then you will be subject to whatever penalty the law imposes. Additionally, you may be found to be partially responsible and liable for the property damage and loss of life in a civil action. Of course, that last part would be the same even if you had insurance, except that the insurance coverage would have helped protect your assets and with your legal expenses. As it is, you will be out of pocket. Insurance coverage does not change legal liabilites, it only provides a source of funding for those liabilites if they arise.

If someone drives a car in your name and kills someone are you in trouble?

You could be named in a law suit. It is your car and the owner is responsible for the vehicle and what it does, as well as who is operating it. It will be your insurance rates that will climb and it will cause you difficulty. Unless you gave the keys to someone who was drunk or unlicensed, you probably aren't going to jail.
