∙ 13y agoYes. Police have 6 months to a year to apply for charges to be issued by a prosecutor on most felonies. Even if the charge is not issued when they apply it does not mean you were illegally arrested.
Another View: Depending on WHAT circumstances the questioner is referring to - - Law enforcement can arrest you based solely on probable cause that you have committed the offense. Formal charges are not filed against you until your first formal appearance in court. Thus, under this scenario, unless you are being arrested on a warrant, you will almost always be arrested PRIOR TO any charges being filed.

∙ 12y agoDepending on where you live, there are usually limitations on how long you can be held without being formally charged with a crime. After that, you have to be charged or released; having a lawyer may expedite this: it's technically illegal for the police to continue to hold you, but sometimes they "forget" (or, more charitably, the police generally have other things to do, and making sure that some slimeball gets out at the precise instant he's supposed to may not exactly be at the top of the priority list).
