The Queen of England, Queen Elizabeth the II, Canadian head of state then choses the Prime-Minister based on who she thinks will keep confidence. The Confidence Vote, is a vote members in parliament make to show their confidence in our Prime-Minister. He needs the majority of the parliament to vote yes to their confidence which is 155 seats. This is usually why the Queen choses the Prime-Minister that leads a party that has won the most seats. They are most likely to keep the vote of confidence. We are using our democratic right by voting for a member of cabinet to put in a vote of confidence or motion of non-confidence for us. But we do not vote for our Prime-Minister.
