For a road bike or hybrid bike, you should be able to straddle the top tube with 1 to 2" of clearance. Whilst on the seat and with one crank arm down, you should have almost a full leg extension. There should be only a slight bend in your knee. Your knee should never lock straight.
For mountain bikes, you want a little more clearance, so rather than focusing on the seat tube height and stand-over clearance, focus on the length of the top tube. Make sure your reach to the handlebars is comfortable. Once again, your leg should be almost fully extended on the down stroke of the pedal crank. If the seat post needs to be pulled up too high to accomplish this leg extension, you should consider one size larger bike.

Depends on how much they owe on the bike and if the price of the bike includes pay off to their bank and you get the title. If there is a lean holder on the bike and after you buy it you don't get a title then no I would not buy the bike.
