If an employer feels that they have been treated unfairly with a citation from OSHA, then they can try to have it appealed. You can do this by contacting OSHA with the information outlined on your citation.
When an employer receives a written notice of citation from OSHA the employer has an opportunity to meet informally with OSHA to discuss the proposed citations and fines, the circumstances that may have been misinterpreted by the OSHA inspector, what has been done since the inspection to fix the problems, and what is planned in the future to address these issues.
After the informal meeting, if OSHA decides to issue citations or fines, you will receive formal written notice.
Once you receive the formal notice of citation, you have 30 days to file a formal notice of contest, if you intend to formally oppose the citation. If you file, there will be a hearing before an Administrative Law Judge working for the Occupational Safety and Health Review Commission. Your advocate can then explain why you think you should not be cited or fined.
If you do not formally oppose the citation, or you loose your appeals, the citation becomes final. Then the thing to do is pay the fine, post the citation in the workplace as required along with an explanation of what you will do to fix the cited problems, and then proceed to fix them expeditiously.
