Does the court order actually state that the non-custodial parent is obligated (not just allowed) to see the child weekly? (This would be unusual, to say the least. Making child support payments is mandatory. Visitation is almost alwaysoptional.)

If so, the non-custodial parent is in violation of the court order. Report it to the court.

If not, then ... nothing, that's what. Nothing illegal is happening. No part of the court order is being violated. Every provision in there remains in force, and if the non-custodial parent decides later to start exercising the weekly visitation privileges, then he or she has the legal right to do so.
