Pedestrians have the right of way. Unless you can prove he/she was grosely negligent or did it on purpose then you are at fault. If you are backing down on your private driveway and a neighbor who walks behind your car on your private driveway is hit and falls down who is at fault? The neighbor pedestrian has been drinking, unstable on his feet was standing in his driveway at his car then suddenly is behind my vehicle.
Should it ever get to court, most judges will assign split negligence to both drivers, although the pressumption is that the driver backing out of the driveway is supposed to be looking both ways up and down down the street.
The driver travelling in reverse is almost always responsible. In this case, he would have had a duty to ensure the road was clear before backing out of the driveway.
As sally goes down the on her , she sees a approaching. She also sees a backing out of a driveway into the street in the of the approaching .She sees the turn,go over the ,and crash into a .
Unless you can prove the other car was violating the posted limit, the onus to ensure the road was clear is completely yours. Even if you CAN prove the other car was speeding, this may not remove all of the fault from you.
In Canada it's the person backing up that would be at fault considering you were slowing down for a stop sign. If you happened to be speeding and came around a corner and hit the person backing out that is a different story.
The person driving on the straightaway/ roadway. Backing out of a driveway or parking spot is the same as a stop sign. The right of way belongs to the person on the road.
Depends on the state, but the old rule is: If a vehicle is backing into the roadway, and it is over 25% into the street (50% of the lane) then the opposing traffic must stop.
Don't force the wording of the event and I believe the answer to: "...when you back into someone....", is evident. Add to it, "...when exiting a private driveway...", where one is always required to yield to the traffic on the public street.
In general, the driver who is backing is considered to be at fault.
regardless.. $90 if your accelerator is stuck remove your foot, lol or be smarter turn the engine off and hit the brakes also if it stays stuck you may have a bad throttle cable go get that checked out and if your in traffic and the pedal gets stuck and you hit someone it's still your fault
Yes assuming you damged either car and your insurance company was informed Because you are at fault an caused damage to a vechicles it goes up more but the stupid thing is when your not at fault it still goes up a lot just ask me I got cut off by a transport truck going the wrong way down a highways and rolled my car and my rates went up a lot.from around 340 to 534 a month thank god they have come down some.
