Depends, why are they asking you to submit to a drug test? If it's just a random test for no reason, there's not much they can do. However, if there is a history of neglect or abuse then they have the power to petition the court for custody of ALL of the children in your home.
It depends on the allegations, and what drug you were positive for. It also matters what state you are in. If you test positive for Marijuana you will not have your children removed. Anything else and the circumstances, state, and allegations as well as the age of your children are a factor.
You will be held responsible for the test the same as if you were guilty as refusing a test the judge will assume the only reason to refuse is that you will show up positive is there really any other reason to refuse
Child Protective Services has NO sense of Humor regarding this kind of thing.
Refusing is worse than failing and what you are trying to avoid is about to happen if you refuse.
If a judge has signed a court order for you to have a drug test as part of evaluation from Child Protective Services, yes you have to submit to a drug test.
The best thing you can do is call CPS (Child Protective Services) and file a report with them. If you are related to the child you can try to obtain custody after CPS investigates.
are u gay
Yes. A judge can order a screen at the recommendation of child protective services, especially if they did previously find reason to remove the child from the household.
Are you asking if there's a correlation between the two? Next time ask an actual question. No one can answer this - they don't even know what you're asking.
Clean up, go to rehab, show them you are fit to be a parent, then file papers to get them back. You have to be completely clean though.
If the drug test is not court ordered, you do not have to submit to it. However, CPS may take your child until a court order is in place.
YES! CHILD PROTECTIVE SERVICES OFTEN RECEIVES REPORTS FROM HOSPITAL SOCIAL WORKERS THAT A NEWBORN HAS TESTED POSITIVE FOR DRUGS. WHEN THIS HAPPENS, RATHER THAN GOING HOME WITH MOM, THESE CHILDREN GO TO FOSTER CARE.
Really?
Yes you can! I have done so, and all attorneys I know will refuse you to take one too until it is court ordered!
Maybe during a drug test.
the hospital is REQUIRED BY LAW to report ALL positive drug tests in newborns to child protective services. There is no way around this
