A theory is an educated and best guess. It is not an opinion. It hasn't been proven (or disproved) yet but can be with addition information. Once proven it will be come a law.
Because people use theory to describe what there opinion is when in fact a theory is hypothesis that has been tested several times and has been proving yet is not universally accepted. Some also regard theory as absolute fact, yet in turn a theory is not universally accepted although it does include factual analysis it is not an absolute law. I like to think of a Theory as a logical way of piecing together evidence to reach a conclusion.

It would be an opinion that is based on observation. A theory that has some basic fact to it. Another theory could be that the individual is an extremely lazy person or that they are preforming a study on a human's ability to waste time.

It does not mater what anyone thinks about the theory of evolution by natural selection. The theory of evolution by natural selection is the best explanation we have for much of the observed and observable fact of evolution. The theory is internally consistent with the fact of evolution, it is supported by myriad lines of converging evidence and it generates testable predictions in the form of scientific hypothesis. The opinion of no one is needed by the theory of evolution by natural selection and educated people have come to accept the theory.
Yes, evolution is a theory. But it is not "just a theory" in the sense that you probably mean. In layman's terms, we might speak of a theory as simply an idea or an opinion, such as "Well, that's YOUR theory..." In science, it is something else entirely, and when something becomes scientific theory, it has been very well substantiated. It is more synonymous with the word "fact" in this usage, unlike the previous usage I used as an example. in fact, all scientific discoveries are considered theories. hell, the fact that our bodies are made up of cells that reproduce is still just a theory.
