Legal fees are not set by law in California, although in some cases such as Class Actions, the legal fees may be limited to no more than a certain percentage. A suit against a health care provider has specific limits, as set forth in Business and Professions Code Section 6146, which go from a high of 40% of the first $50,000 recovered, down to 15% of the amount recovered in excess of $600,000. (4) Unless the claim is subject to the provisions of Section 6146, a statement that the fee is not set by law but is negotiable between attorney and client. (b) Failure to comply with any provision of this section renders the agreement voidable at the option of the plaintiff, and the attorney shall thereupon be entitled to collect a reasonable fee.
