Lookback refers to the process of examining something that happened earlier. For example, if you file for bankruptcy, the courts will look back at your credit charges to determine if you increased spending in the two years prior to bankruptcy, thus nullifying your case because of fraud on the creditors.

Does an irrevocable trust remove an asset from Medicaid consideration after the 5 yr lookback period?

It should but the trust must be drafted by an attorney who specializes in estate planning, tax law and trust law. Errors in the drafting of that type of trust will leave the trust property exposed and can cause costly problems down the line.

What is jainism's biggest celebration?

Paryushan is an important festival among the Jain festivals. It happens during late August / September commencing on the twelfth day of the fortnight of the waning moon cycle and ending in the fourteenth of the fortnight of the waxing moon cycle. This is generally a rainy season in Northern parts of India. During this 18 day period Jain scholars and monks visit temples and explain the Jain philosophy. Jains during this period practice external austerities such as fasting, limiting their normal activities so as to reduce the harm to worms and insects that thrive during this season. At the conclusion of the festivities, a lookback is encouraged, and Pratikraman is done for repentance of faults and forgiveness is given and asked for from all.

Can Medicare or Medicaid pierce an irrevocable trust?

It depends on how the trust is drafted. A properly drafted irrevocable trust, in Florida, will be invisible to Medicaid (Medicare doesn't factor assets into whether or not one is qualified the way Medicaid does). However, transfers of assets into the trust must be done 5 years before applying to medicaid or medicaid will assess a transfer penalty (this is referred to as the "five year lookback"). The transfer penalty is a period of ineligibility for certain medicaid benefits depending on the size of the transfer. As a result, irrevocable trust planning would not be appropriate for all Medicaid planning scenarios.

If you have scar tissue from a surgery you had 20 years ago that needs to be removed but have never been treated for can your insurance deem it as pre-existing?

AnswerI would think so, however be sure to check the definition in your policyCA Insurance Code 10700 q) "Preexisting condition provision" means a policy provision that excludes coverage for charges or expenses incurred during a specified period following the insured's effective date of coverage, as to a condition for which medical advice, diagnosis, care, or treatment was recommended or received during a specified period immediately preceding the effective date of coverage. Is the scar removal cosemetic or a medical necessity? What was put down on the application?AnswerScar removal is generally covered under cosmetic and since it sounds like you didn't have treatment during the lookback you should be fine.
