Private land is land to which the public has no right of access. In countries where private ownership is permitted, a property owner has the right to prevent others from entering her/his land. An owner of land has the right to the exclusive use and possession of the land and can leave it to her heirs by will. If she has no will the land will pass to her heirs under the law.

Public land is open to public use. Examples are parks, school properties, recreation areas, sidewalks, public streets, libraries, courthouses, bike trails, conservation areas, etc.

What lands are exempted from comprehensive agrarian reform program?

Lands exempted from the Comprehensive Agrarian Reform Program (CARP) typically include those devoted to national defense, educational institutions, and socialized housing projects, as well as lands already owned by farmers or agricultural workers. Additionally, lands with an area of less than five hectares and private lands that are not primarily for agricultural use may also be excluded. Certain ancestral lands and areas covered by the Indigenous Peoples Rights Act are also exempt. These exemptions aim to balance agricultural reform with other national interests and property rights.
