There is always a chance of contracting it but then there is a chance of not contracting it too. Some peopel manage not to contract it from their partners, if they take a few precautions.
If your partner has it then they should be willing to take antiviral medication or suppressants regularly to help prevent break outs and reduce thier chances of shedding the virus in between break outs.
You should never have intercourse or give them oral sex around the time a break out occurs, wait even a few days after the break out heals to resume having sex.
Your partner should be honest and get to know their symptoms so they can abstain from having intercourse until their break out is over.
It's safer to have intercourse while there are no signs or symptoms of a break out.
Condoms can be used in between break outs if that makes you feel more comfortable.
In the end if you know they have it and you still want to be with them, then it's your body and your choice.
