Homicide refers to the act of a human killing another human. Murder, for example, is a type of homicide. Homicide is not always punishable under criminal law and is different than a murder from such a formal legal point of view.

In the United States murder is classified in several ways.

  • First Degree: A murder that is willful and planned (premeditated).
  • Second Degree: Murder that was not premeditated in advance.
  • Voluntary Manslaughter: The intentional killing that involved no prior intent to kill, but was committed under circumstances that would cause a reasonable person to become so emotionally hurt or mentally disturbed. Example, a bar fight where discovers infidelity.
  • Involuntary Manslaughter: Lack of intention to cause death, but involving an intentional or negligent act which lead to the death. For example, a drunk driver.
