well first you have to shift it into the reverse gear. then you look over your shoulder (right if you're backing out right left if you're backing out left) and very, very gently tap the gas pedal. Most of the time the vehicle will back itself out without the gas pedal but if it isn't moving then gently tap the gas.
It will probably depend on who was backing out first. The first one backing should have the right of way. Also the driving laws don't officially apply in private parking lots. The insurance companies will look at the collision based on driving laws though.
Originally you are at fault unless you were in the process of backing up before the offender had arrived. If however he was present before you started to back up and claims he was unable to stop than you were at fault. GOOD LUCK IN COURT :)

Most defintley his fault, you were backing out, he should have saw you first.
It is always advisable to have a qualified mechanice take a look at a used vehicle before you purchase it.
