There currently isn't a Texas minimum wage, so they follow the federal minimum wage... I do believe that Texas will have a new minimum wage coming into affect Jan 09' There is a current minimum wage for servers and it is the Federal Minimum of $2.13 per hour. There was only an increase for those not in a server, waitstaff job.
2009 Minimum wage for Florida servers is calculated as follows: Florida Minimum Wage $7.21 per hour less Fair Labor Standards Act (FLSA) tip credit of $3.02 for a direct wage owed by employer of $4.19 per hour. Overtime is (7.21 * 1.5) minus $3.02 FLSA tip credit for a total wage of $7.80 per hour plus tips. Effective July 24, 2009 this will change because the federal minimum wage will increase to $7.25 and change the FLSA tip credit. This answer cost me about $10K a couple of years ago.

The minimum wage for restaurant, diner, and bar servers is much lower than the minimum for other workers. Your employer is obligated to pay you the server minimum, nothing more. It sounds like you need to find a more popular establishment. *In Kentucky and Indiana, the employer is supposed to pay you the difference between what you make in tips and the minimum wage if your tips do not bring you up to that. It is very seldom that tips do not bring the wages of a server up to minimum wage when averaged over a period of a few days to a week, so employers assume that overall you are making minimum wage or more and do not make up the difference if you have a bad day every now and then.
