It depends on a variety of factors, what situation you are in. Where you are smoking (in the car, near or in school, your house, on the street, in a park, the time, etc.). The penaltly could defninitely vary depending on how, where, and when you are caught.
Beyond that, it greatly depends on the cop, and your history. Your history is so important; don't be on probation or parole, it could be very serious.
If you are driving and you are smoking and you own the car it can get taken but again, it depends on the cop.
It could be nothing, or you could lose more than the marijuana. You could lose your car, bike, boat, etc. You could go to jail if you don't have identification. If you're a minor they can call the parental units. However, there is always a chance of going to jail.
B: In NY state possession of 25 grams or less has been de-criminalized. That is to say if you are caught for the first time. The second time you will have to show up in court but it is still a minor offense and you will not go to jail. As the number of times caught the punishment goes up. If you are caught with more than 25 grams or you are smoking in a public place then you will be charged around 250$ and might go to prison.
