From a criminal standpoint, it depends upon the state involved. Some states, for example, classify it as a misdemeanor and some as a felony. Likewise, some states differentiate in the categorization depending upon the the status of the victim (for example, if an elderly person was victimized, the act may carry a more severe penalty), and the number of policies sold and hence, the number of victims.

From a civil standpoint, "punishment" can be construed to mean an award of damages to an aggrieved person. This could arise if the victim placed his/her trust in the supposed knowledge and acumen of the unlicensed agent, and the victim was damaged as a result of the fact that the agent was not, in fact, licensed. An example of this might be that the insurance that the victim thought was being purchased never went into effect because the agent was never authorized to represent the insurer.
