Lesser penalties for lesser offences is a good system. It gives the offender an opportunity to think about his/her behaviour lest they get a heavier penalty for continueing on with their bad behaviour. Mostly the system works for sensible folk. In some cases of course people are so bad (and dumb) they continue on and move to the next level where prison is the only answer to their problem. The system is designed to be compassionate yet firm for the sake of the safety of the general population.
