Requirements regarding what exactly? As adopted you are a part of their family just as if you are their biological child with the same rights etc and they decide over you just like in any other family until you reach the age of majority in your state, usually 18. If you are adopted at 16 you have the right to consent to the adoption or not. If you want early emancipation the requirements differ slightly from state to state and not all states offer it but the law is the same regardless if you are adopted or not.

There are different requirements for safety for a 16 year old than for an adult because a 16 year old is not yet an adult. As a minor, a 16 year old is not legally able to make the same sorts of decisions that an adult can, and is also more subject to damage from certain situations and an adult would be, on average.

Probably the 16 year old, depending on how much he/she has learned. The 5 year old may be more intelligent, or notices things the 16 year old doesn't though. Remember, the 16 year old has had 11 more years to learn.
