A taxpayer may take a depletion deduction only if he owns an “economic interest” in the mineral deposit or the timber. Owners of an economic interest include: (1) owner-operators; (2) lessors and lessees, even where the lessee has an economic interest under a lease terminable without cause on short notice; (3) owner of a royalty interest, or retained net profits interest; and (4) owners of a production payment to the extent it isn't treated as a mortgage loan.
